Agreement to Terms

By accessing or using ReplyFix's SMS AI answering service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

Description of Service

ReplyFix provides an AI-powered SMS answering service for home service businesses. The Service includes:

• Automated SMS responses to customer inquiries
• AI photo analysis for problem diagnosis
• Automated booking and scheduling
• Customer conversation management dashboard

Account Registration

To use the Service, you must:

• Be at least 18 years old
• Operate a legitimate home services business
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update any changes to your account information

You are responsible for all activities that occur under your account.

Pricing and Payment

• Subscription fees are billed monthly in advance
• Pricing is based on the plan tier selected (Solo/Team/Business)
• Payment is processed securely via Stripe
• All fees are non-refundable except as required by law
• We reserve the right to change pricing with 30 days notice
• Failure to pay may result in service suspension

Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose
• Send spam, unsolicited messages, or marketing without consent
• Violate TCPA regulations or other telecommunications laws
• Attempt to access or interfere with our systems
• Use the Service to harass, abuse, or harm others
• Impersonate another person or business
• Share your account credentials with unauthorized parties

AI Accuracy and Liability

• AI diagnoses are estimates based on available information
• Final pricing and scope of work are your responsibility
• You should review bookings before accepting jobs
• ReplyFix is not liable for incorrect AI assessments
• You maintain full control and can override AI decisions

Data Ownership and Privacy

• You retain ownership of your business data and customer information
• We may use aggregated, anonymized data to improve our Service
• Customer photos are automatically deleted after 90 days
• You can export your data at any time

Service Availability

• We strive for 99.5% uptime but cannot guarantee uninterrupted service
• Scheduled maintenance will be announced in advance when possible
• We are not liable for service interruptions beyond our control
• Emergency maintenance may be performed without notice

Cancellation and Termination

You may:

• Cancel your subscription at any time (no penalty)
• Access remains until the end of your billing period
• Export your data before cancellation

We may terminate your account if:

• You violate these Terms
• You engage in fraudulent activity
• Payment fails and remains unpaid for 7 days
• Your use harms our Service or other users

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• ReplyFix is provided "as is" without warranties of any kind
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid in the past 12 months
• We are not responsible for lost revenue, customers, or business opportunities
• You assume all risk from using AI-generated content

Indemnification

You agree to indemnify and hold harmless ReplyFix from any claims, damages, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or violation of any rights of another party.

Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email at least 30 days in advance. Continued use of the Service after changes constitute acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the State of Delaware, United States. Any disputes shall be resolved in the courts of Delaware.
